Entry details

  • The US has ended automatic EAD renewal extensions for H-4 visa holders, spouses of H-1B workers.
  • Previously, timely-filed renewals granted up to 180 days of automatic work authorisation after EAD expiry.
  • H-4 spouses must now stop working if their permit expires before renewal approval.
  • The H-4 EAD programme itself, created in 2015, remains in place; only the automatic extension is scrapped.

The United States has ended automatic work permit renewals for H-4 visa holders, spouses of H-1B skilled workers, tightening a rule that had allowed them to keep working while renewal applications were pending.

The change reverses a measure that let H-4 spouses continue employment on an expired Employment Authorization Document (EAD) for up to 180 days, provided they had filed a renewal application on time. That automatic extension no longer applies.

Who is affected?

The rule hits spouses of H-1B visa holders, who hold H-4 dependent visas. Many of these spouses work in the US under EADs tied to their partner's status. The affected group is large: H-4 spouses, a majority of them women, form a significant part of the skilled-immigrant household workforce in sectors such as technology and healthcare.

Under the previous arrangement, an H-4 spouse could file a renewal and keep working during processing. Now, a lapse between expiry and approval means a forced stop to employment.

What changes in practice?

The mechanism is simple. Before, a timely-filed renewal triggered an automatic extension of work authorisation. Now, that safety net is gone.

  • Work authorisation ends when the EAD expires.
  • Employment must stop until USCIS approves the renewal.
  • Gaps in work can affect employer sponsorship, payroll continuity, and in some cases health insurance tied to a job.

Employers now face a compliance question as well: continuing to employ someone whose EAD has lapsed risks penalties. The practical advice circulating among immigration practitioners is to file renewals as early as the rules allow.

Why does this matter?

H-4 EADs have been politically contested for years. The programme was created in 2015 under the Obama administration to help retain skilled workers whose spouses would otherwise be barred from working. Successive administrations have tried either to rescind or preserve it, making it one of the most litigated benefits in the US skilled-immigration system.

The latest change does not abolish the H-4 work permit itself. It removes the automatic renewal extension, which is a procedural protection rather than the underlying benefit.

In plain terms: H-4 spouses can still apply for work permits, but they can no longer count on automatic continuity of employment while those applications are processed.
